Business with Austrians are profitable for mayor Florea

The mayor of Târgu Mureș, Dorin Florea, is charged with favouring the Austrian company Ivenio Consult in the auction for the purchase of a waste products packing line. The accusation has been subtly made by the Swedes from Flexus Balasystem, who want to have the public auction cancelled. The Austrians won, but they are said to have been the only party in the auction. The representatives of Flexus Balasystem claim they have quoted the point of view of the Romanian Ministry of Public Finances that pointed out that “the town hall had to organize the auction once again”. The damage, according to the estimation of the Swedish company, reaches 50 billion lei.

The conflict between the Swedish company Flexus-Balasystem and the Executive in Tîrgu Mureș started in October 2004, after the public auction took place. The issue referred to selecting the supplier of the waste products packing line. The winners were the Austrians from Ivenio Consult. They signed the contract with the Executive that was supposed to pay almost three million Euros, before taxes, in a period of 36 months, the price quoted by Ivenio.

Mocking at the Ministry of Public Finance

After the Court had rejected the claims of Flexus, its legal representatives proved that the Court had not taken into consideration the point of view of the Ministry of Public Finances. The institution certified that it was mandatory for the municipality to organize the auction once more, as it did not have the right to assign the contract to the only company competing.

In the petition, the representative of Flexus showed that the auction should be canceled since it was not the municipality to have legal support for signing the contract, but the municipium council.

Immorality

Apart from ignoring the point of view of the Ministry of Public Finance, another problem of the auction is the price. Ivenio Consult asked for the delivery of the waste packing line 2,97 million euro, without taxes, while Flexus, according to their own statements, would have asked half the price, i.e. 1,49 million euro. Moreover, Ivenio is not a manufacturer of such packing lines, but a go-between, a reseller dealing particularly with German companies such as Schuster Engineering. Such a deal has definitely a serious commission, so the difference between the price offered by Flexus, a manufacturer of such production lines since 1992, and the price offered by Ivenio could be 1,5 million euro.
