ECHR rejected the contestation of the Romani from Hadareni

The European Court of Human Rights announced on Monday that it had rejected the contestation submitted by the five Roma from Hadareni township who requested the revision of the adjudgment announced by the ECHR on June the 12th. The five persons requested in September the revision of the adjudgment by which the European court sentenced the Romanian government to payment of indemnities in amount of 238.000 Euros, for failing to respect several rights and liberties, repeatedly failing to respect interethnic conflicts in September 1993, when four Romani citizens were murdered and 12 houses were set on fire in Hadareni.

Indemnities were granted, but only for infringing these rights following June 20th 1994 when Romania ratified the European Convention of Human Rights, but the Romany from Hadareni requested the European court to supplement the indemnities also for the September 1993-June 1994 period. The case was adjudged by the Grand Chamber of the ECHR, which returned a verdict in this case on November the 30th. In Ludus, last week was to take place a new law-term for the adjudgment of the contestation to enforced execution of estate, formulated by the Romanians from Hadareni, but the case will most likely be deferred once again, while waiting for the publication of the ECHR sentence in the Official Gazette. Istvan Haller, the representative of the Pro Europa League, organization assisting the Romani requesting the revision of the ECHR sentence, considered that “the resolution of the Grand Chamber respects the European jurisprudence and represents a confirmation of the fact that the court from Strasbourg has not made statements with regard to the events of September ’93, but regarding the infringement of human rights by the Romanian government.” Haller (photo) declared that this resolution was predictable and expressed his hope that the magistrates from Ludus will interpret the ECHR resolution correctly.
